1. Purpose of the document

The purpose of this document is to inform any natural or legal person of the intellectual property rights held by Nereva SA (“Nereva”, “we”, “us”, “our”) and of the strict conditions governing the use of the Nereva trademark, its visual identity, its content, and its technological innovations. This document supplements Nereva’s Terms and Conditions of Use (TCU) and applies independently of any contractual relationship with Nereva SA.

2. Ownership of intellectual property rights

Nereva SA is the exclusive owner of all intellectual property rights relating in particular to:

the Nereva trademark,
its logo and all variations thereof,
its visual identity and brand guidelines,
its visual, graphic elements, images and photographs,
its software, interfaces, algorithms and databases,
its technological innovations subject to protection under patent law.

No right, licence or authorisation is granted implicitly by mere access to the website, the platform or the Nereva Services.

3. Protection of the Nereva trademark

The Nereva trademark is protected under Swiss and international trademark laws. Any reproduction, imitation, adaptation, representation or use of the Nereva trademark, in any form and on any medium whatsoever, without prior written authorisation from Nereva SA, is strictly prohibited.

4. Protection of visual identity and content

The visual identity of Nereva, including in particular:

the logo,
colours,
typography,
brand guidelines,
graphic elements,
visuals, images, photographs and editorial content,

is protected by copyright law and, where applicable, by trademark law.

Any unauthorised reproduction, distribution, modification, adaptation or exploitation of these elements constitutes an infringement of Nereva SA’s intellectual property rights.

5. Protection of technological innovations and patent applications

Nereva SA has filed patent applications in Switzerland, extended at the European and international levels, in particular through the priority and protection mechanisms provided by applicable conventions.
As such, Nereva SA benefits from the rights and protections granted by applicable law during the filing, examination and, where applicable, publication phases of such patent applications. The technological innovations developed by Nereva SA are the subject of pending patent applications in accordance with Swiss law, European patent law and international industrial property conventions. Any unauthorised exploitation, reproduction, imitation, implementation or use of technologies covered by these patent applications may give rise to civil and, where applicable, criminal liability, within the limits provided by applicable legislation.

6. Territorial scope of protection

Nereva SA’s intellectual property rights are protected in multiple jurisdictions, including, without limitation:

Switzerland,
Australia,
Canada,
United Kingdom,
Japan,
Sweden,
United States,
Russia,
Benelux,
China,
Germany,
Spain,
France,
Italy.

This list is not exhaustive and may evolve depending on extensions of protection carried out by Nereva SA.

7. Exclusive rights and prohibited uses

Without prior written authorisation from Nereva SA, the following are strictly prohibited, in particular:

the use of the term “Nereva” for commercial or promotional purposes,
the use or exploitation of the logo or any similar or confusing signs,
the imitation of the visual identity or any distinctive elements,
the direct or indirect exploitation of technologies protected by patent applications,
any use likely to create confusion with the activities, products or services of Nereva SA.

8. Domain names, social media and digital identities

The creation, registration or use of domain names, social media accounts, applications, digital services or online identities incorporating the Nereva trademark or similar signs, without prior written authorisation, is strictly prohibited. Any such use constitutes an infringement of Nereva SA’s intellectual property rights.

9. Monitoring and enforcement of rights

Nereva SA implements proactive and systematic monitoring to detect any unauthorised use of its intellectual property rights. Nereva SA works in particular with Bugnion SA, its intellectual property representative, to ensure the protection, management and enforcement of its rights in Switzerland, Europe and internationally.

10. Authorisation request procedure

Any use of the Nereva trademark, its visual identity, its content or its protected technologies for commercial, promotional or institutional purposes requires prior written authorisation from Nereva SA. Any request must be submitted in writing to Nereva SA or its legal representative. The absence of a response shall not be deemed acceptance.

11. Liability in the event of infringement

Any unauthorised use of Nereva SA’s intellectual property rights may give rise to civil and, where applicable, criminal liability on the part of the infringer. Nereva SA reserves the right to take any appropriate legal action to put an end to the infringement and to obtain full compensation for the damage suffered.

12. Civil and criminal sanctions

In accordance with applicable law, infringements may give rise, in particular, to:

damages,
penalty payments,
seizure or destruction of infringing materials,
immediate cessation of the unlawful activity,
criminal sanctions, including fines and, where applicable, custodial sentences depending on the seriousness of the infringement.

13. No waiver or implied tolerance

The fact that Nereva SA does not immediately initiate legal proceedings in the event of an infringement shall not be construed as tolerance, waiver or limitation of its rights.

May I use the term “Nereva” or the logo for my product or service?
No. Any use without prior written authorisation from Nereva SA is strictly prohibited.

What are the consequences of an infringement?
Civil and criminal sanctions may be imposed in accordance with applicable law.

15. Governing language

The French version of this document shall prevail for legal purposes. Any translation is provided for informational purposes only.
